Topic Fee Shifting in Patent Litigation:  What does it take to make an exceptional case under 35 U.S.C § 285, or how can you avoid paying the other side’s attorneys fees

Both the U.S. Congress in its patent reform proposals and the U.S. Supreme Court in its recent grant of certiorari in Highmark v. Allcare and Octane v. Icon Fitness cases, have taken the issue of when to grant fees to the prevailing party in patent litigation, presumably as a means to determine abusive litigation tactics.

Join the Co-Chairs of our Amicus Brief committee as they lead a discussion regarding the facts of these two cases, the Amicus Committee's proposal on addressing these issues at the Supreme Court, and various related proposed bills being introduced in Congress.
