The scope of patent eligibility under 35 U.S.C. §101 has particularly challenged the courts since the onset of the information and biotechnology ages.  The test devised by the Supreme Court in Mayo v. Prometheus and carried forward in Alice v. CLS Bank International has not laid the issue to rest.  Instead, its application has led to even greater uncertainty by blocking a number of information technology and biotechnology innovations, among others, from evaluation under Sections 102, 103 and 112. 

Many in the IP community are turning their attention from the question of what is patent eligible under Section 101 to what should be patent eligible.  That is, how Section 101 could be modified or rewritten to better “promote the progress of science and useful arts.” 

Thought leaders from the Federal Judiciary, the Congress, and some of the nation’s most prominent IP law associations and industry associations, will come together to discuss what a legislative fix, by amending Section 101, might entail.  

David Kappos, former USPTO Director, and NYIPLA Immediate Past President Dorothy Auth will facilitate a town-hall-style discussion, led by:
