David Almeling is one of the country’s leading attorneys in trade secret law.  David will provide an overview of what has happened in the last two years since the Defense in Trade Secret Act (DTSA) has been codified as well as recent trade secret decisions in federal and state courts.

Deirdre Wheatley-Liss counsels business owners and is a frequent lecturer on best practices and corporate governance as related to privilege and cybersecurity.  Deirdre will provide an overview on cybersecurity and how businesses can plan and avoid infiltration of unwanted software and exfiltration of sensitive material like intellectual property and privacy data.

2:00 - 2:45 Discussion on Late-Breaking Trade Secrets and Cybersecurity Cases/Issues Daniel Levy, Epstein Becker & Green, P.C.

Daniel R. Levy focuses his practice on employment disputes and litigates trade secret, non-compete, non-solicitation, raiding, and other restrictive covenant matters in the medical devices, pharmaceuticals, health care, and financial services industries.  Dan will give an interactive presentation on late-breaking trade secrets and cybersecurity cases and issues.

3:10 - 3:50 A View from the Trenches Meredith Dearborn, Boies Schiller & Flexner LLP and John Gray, Perkins Coie LLP

Meredith Dearborn represents clients in high stakes litigation and recently represented Uber in Waymo v. Uber, a high profile trade secrets matter concerning self-driving cars.  Meredith will discuss litigation strategies for defending complex trade secrets litigation and specifically what should be considered a “trade secret” and whether the lessons and skills an engineer learns on the job should be included.

John Gray focuses on trade secret, patent, copyright, and trademark litigation. He represented Zillow in Move Inc. v. Zillow Inc. an unfair competition, trade secret misappropriation dispute where the plaintiff sought more than $2 billion dollars in damages.  John will present some of the lessons learned from his complex trade secret misappropriation cases, including insights on preparatory measures and litigation strategies for asserting or defending a trade secrets case.  

3:50 - 4:30 Protecting the Corporate Client Ken Corsello, IBM Coporation and Mark Schildkraut, Becton Dickinson and Company
Ken Corsello is the IP Law Counsel for IBM's Watson Customer Engagement business unit, which provides solutions for marketing, electronic commerce and supply chain activities. Ken will discuss what in-house attorneys should focus on so that their company takes adequate efforts to maintain the secrecy of its valuable information, and how to react if information is suspected of being misappropriated.

Mark Schildkraut is an Associate General Counsel for Cybersecurity and IP at Becton Dickinson.  Mark will provide the in-house perspective for protecting the corporate client from trade secret misappropriation and cybersecurity threats. 

4:30 - 5:30 Cybercrime and IP Crime: Working With The Government and Ethical Considerations Brian Levine, United States Department of Justice

Brian Levine is a Senior Counsel with the Computer Crime and Intellectual Property Law Section (CCIPS) at the U.S. Department of Justice, and National Coordinator for more than 270 federal prosecutors who specialize in computer crime and intellectual property crime.  Brian was one of the lead prosecutors in the first U.S. criminal trial of a PRC entity for theft of trade secrets, Sinovel Wind Group Co. Ltd.  After an eleven-day jury trial, the company was convicted of a trade secret theft that nearly destroyed an American company. Brian will discuss the current threat environment, the role of the Department of Justice in cybercrime and IP, developing relationship with law enforcement before an incident, the importance of involving law enforcement as soon as an incident occurs, and common concerns regarding involvement of law enforcement with an emphasis on the ethical considerations.
