The Patent Litigation and Amicus Brief are presenting a joint panel arguing various scenarios of alleged divided infringement based on a modified fact pattern from the On Demand Machine Corp. v. Ingram Indus. Inc. (Fed. Cir. 2006), which pre-dated the Akamai, Centillion, Muniauction, and BMC Resources cases. Using this modified fact pattern, the panelists will present oral arguments under the current state of the law of divided infringement addressing both method and system claims.
