Joel Karni Schmidt, a partner at Cowan, Liebowitz & Latman, P.C., will discuss how hashtags and emojis are currently being used by companies and under what circumstance they can function as trademarks. The program will also cover recent changes to the USPTO’s Trademark Manual of Examining Procedure relating to hashtags, as well as examples of actual trademark applications for hashtags and emojis.  Trademark use and clearance issues relating to hashtags and emojis, as well as potential false advertising claims that can arise through the use of hashtags and emojis will also be discussed.
