NYIPLA, in conjunction with the Second Circuit, is hosting a Moot Court Argument CLE Program followed by cocktails and hors d'oeuvres, on Thursday, July 16, from 5:30pm to 8:30pm at the Thurgood Marshall Courthouse, Room 1703.

Participating Firms


 

 
 

Each firm will present an oral argument on behalf of a different interested party. The hypothetical fact pattern addresses copyright issues surrounding a company’s promotional materials and video recording of a new product launch.  The parties and their amicus curiae will address two questions:  (1) Does publication of portions of a promotional material booklet constitute a fair use under the Copyright Act?  (2) Does the creation and posting of a transcript of the video recording of a product launch constitute a fair use? The Judges will hear argument, retire to conference the case, and return to the bench with their comments. They will also answer questions related to the mock argument and their deliberations in the case conference.
