Legal issues surrounding Native Advertising and the FTC's Updated Guides in Digital Advertising, focusing on how to contextually integrate advertising content into the digital platform on which the advertising is being delivered, while avoiding consumer deception.  Proponents of Native Advertising herald it as an online advertising method in which the advertiser garners enhanced consumer attention by providing content in the context of the user's experience, whereas opponents view it as an inherently deceptive means to affect consumer behavior because consumers do not realize the content they are consuming is advertising.

Mr. Robert deBrauwere, Pryor Cashman, will address both perspectives and will show examples of Native Advertising that will and will not likely pass muster.
