June Cohan will address patent subject matter eligibility, including recent judicial decisions and USPTO examination guidance. Since 2012, the Supreme Court has re-invigorated this area of patent law by issuing three decisions on eligibility that have greatly impacted how many patents are prosecuted and litigated. The USPTO responded to these decisions by issuing two sets of examiner guidance this year: one for nature-based inventions such as DNA and methods involving biological correlations, and the other for claims directed to abstract ideas, and by obtaining public feedback on the guidance and the Supreme Court decisions. At the program, USPTO personnel will discuss how the USPTO is revising and updating its examiner guidance in view of public feedback, including specifics on which areas of the guidance are changing. The program will also include discussion of pending cases before the Federal Circuit that involve eligibility issues, and an interactive discussion with attendees.
